 Although technically he's on an ice cream diet, he's also allowed to eat lots of other desserts like cakes, pies, pastries, and marshmallows.  He's talking to the audience (as a literary device, I think they call that "dramatic irony" or "breaching the 4th wall") and he sees you coming after him with a funnel.  He knows there's no escape. |
